USDA Assistance Programs

On May 14, USDA first announced the application process for the CARES Act-funded Coronavirus Food Assistance Program (CFAP). For a summary of the information and forms needed to apply, click here. On May 19, USDA published the rule to officially implement the program. Unfortunately, the rule does not yet extend access to relief funds to several agricultural sectors where more information is needed—including horticulture. If you would like to submit information to assist USDA in determining how to structure support for horticultural producers, click here to draft and submit comments to the USDA.

NOTE: You must provide your own comments, specific to your own nursery/greenhouse. All comments submitted to the Federal Government in the rulemaking process are included in the public record and are accessible to all. For this reason, AmericanHort advises members not to provide confidential business information in any regulatory submissions.

On April 23, a coalition of members in the House and Senate sent letters to the President asking for clarification to the USDA’s Coronavirus Food Assistance Program (CFAP). The letters are available here: House, Senate.

Business Assistance

This page provides information from the Small Business Administration (SBA) and other resources that are designed to support small businesses during the coronavirus pandemic.

If you are a small business and need help you should apply for the disaster loan assistance from the Small Business Administration (SBA) upon promptly completing an assessment of your situation. Click here to access the SBA website.

There are two main SBA programs helping small businesses:

Application for forgiveness of Paycheck Protection Program loans is now available. Click here for more information.

The Paycheck Protection Program is a loan designed to provide a direct incentive for small businesses to keep their workers on the payroll.

  • SBA will forgive loans if all employees are kept on the payroll for eight weeks and the money is used for payroll, rent, mortgage interest, or utilities.
  • The Paycheck Protection Program will be available through June 30, 2020.
  • This program is for any small business with less than 500 employees (including sole proprietorships, independent contractors and self-employed persons), private non-profit organization or 501(c)(19) veterans organizations affected by coronavirus/COVID-19.
  • Lenders may begin processing loan applications as soon as April 3, 2020.
  • The loan will be fully forgiven if the funds are used for payroll costs, interest on mortgages, rent, and utilities (due to likely high subscription, at least 75% of the forgiven amount must have been used for payroll). Loan payments will also be deferred for six months. No collateral or personal guarantees are required. Neither the government nor lenders will charge small businesses any fees.
  • This loan has a maturity of 2 years and an interest rate of .5%.

The Treasury Department has been publishing frequent updates to an April 6 FAQ on the PPP (latest version available here) that specifically addresses seasonal businesses (Question 9) among other questions.

Note: The Treasury Department has issued updated guidance for seasonal employers regarding the 12-week payroll window for seasonal employers. This newly released interim final rule is available here.

On May 15, the Treasury Department and Small Business Administration (SBA) released guidance on loan forgiveness under the Paycheck Protection Program, along with a loan forgiveness application.

According to Treasury and SBA, companies can seek loan forgiveness at the conclusion of the eight-week covered period, which begins with the disbursement of their loans. Additional regulations and guidance is also expected shortly from the SBA.

The loan forgiveness form and instructions include several measures, including:

  • Options for borrowers to calculate payroll costs using an “alternative payroll covered period” that aligns with borrowers’ regular payroll cycles.
  • Flexibility to include eligible payroll and non-payroll expenses paid or incurred during the eight-week period after receiving their PPP loan.
  • Step-by-step instructions on how to perform the calculations required by the CARES Act to confirm eligibility for loan forgiveness.
  • Implementation of statutory exemptions from loan forgiveness reduction based on rehiring by June 30.
  • Addition of a new exemption from the loan forgiveness reduction for borrowers who have made a good-faith, written offer to rehire workers that was declined.

The SBA’s Economic Injury Disaster Loan (EIDL) program provides small businesses with working capital loans of up to $2 million to help overcome the temporary loss of revenue.

  • The loans may be used to pay fixed debts, payroll, accounts payable, or other bills that can’t be paid because of the COVID-19 outbreak.
  • The interest rate is 3.75 percent for small businesses without credit available elsewhere, and businesses with credit available elsewhere are not eligible to apply for assistance.
  • The maximum term is 30 years.
  • The SBA website currently says “farms” are not eligible, but it is our understanding that will likely be changed soon to include all green industry businesses as a result of expanded eligibility provisions passed in the CARES Act.
  • This loan is not eligible for debt forgiveness.

Borrowers may apply for PPP loans and EIDL loans; However, you cannot use both loans for the same purpose. If you accept the EIDL loan, and you subsequently qualify for the PPP loan, you can re-finance the EIDL loan with the PPP loan.

Among other provisions included in the bill signed by the President on April 24, clarification that the EIDL program is accessible to other agricultural businesses. While nurseries were already included in the underlying EIDL program, the rest of the green sector will now be able to apply for the $10,000 EIDL Advances and $15,000 low-interest loans through the SBA.

The exact terms of loans are determined solely by the lender(s) and AmericanHort can make no representation as to the accuracy or completeness of any information contained herein.

Main Street Lending Program (MSLP)

While not subject to forgiveness like the PPP loans above, the Federal Reserve's Main Street Lending Program seeks to assist banks in extending credit to small- and medium-sized businesses which were in good financial standing before the crisis by offering 4-year loans to companies employing up to 10,000 workers or with revenues of less than $2.5 billion.

On April 30, the Federal Reserve Board officially announced the increased scope and eligibility of the Main Street Lending Program. In addition to creating a new loan option under the MSLP, the Board lowered the minimum loan size for certain loans to $500,000 and expanded the pool of businesses eligible to borrow under the program.

Income Tax Filing and Payment

On March 20, President Trump announced that the IRS would extend filing and payment deadlines for individual and business filers until July 15, 2020. There will be no penalties or interest on taxes owed if filed by the new deadline. More information is available from the IRS’ Coronavirus relief page.

Securing Inclusion in USDA’s CARES Act Response

On April 10, AmericanHort led a letter to Secretary of Agriculture Sonny Perdue, in which 105 organizations urged the Secretary to ensure any forthcoming USDA assistance includes nursery and floriculture crop farmers devastated by this unprecedented COVID-19 crisis. On April 3, AmericanHort CEO Ken Fisher and SVP of Advocacy Craig Regelbrugge sent a letter to Secretary of Agriculture Sonny Perdue to help ensure that the horticultural industry is fully embraced in the USDA-directed relief funding recently provided through the CARES Act. Industry Specific Information

Garden Retail Centers

Amid a growing trend of mandated business closures, many are wondering what they can do to help their business weather the storm. Decisions on whether businesses can operate will be made, and those with the ability to influence those decisions will be best located, at the state or local level. Our strategy is to equip our members and state/local partners with the arguments to make their case in those discussions.

AmericanHort has collaborated with other industry leaders and organizations, to develop a statement you can use in communicating with government officials. We encourage you to borrow this statement and proactively reach out to your leaders to demonstrate the essential nature of retail garden centers in discussions about mandated business closures.

On March 18, AmericanHort briefed the National Association of State Departments of Agriculture on our concerns about the importance of these retail operations. State Agriculture Secretaries and Commissioners are key allies in the effort to articulate why these businesses should be allowed to continue operations, even in a modified capacity.

We have also been in communication with the office of Secretary of Agriculture Sonny Perdue and other USDA staffers requesting that they keep the green industry in mind as “essential agriculture” as any new regulations are developed.

Growers & Producers

We are not currently aware of any jurisdiction limiting the ability of growers to continue operations. As a rule, agricultural production is generally considered a critical/essential component of the national infrastructure and we expect it will continue to be treated as such in these circumstances. If you're hearing anything different, please let us know.

On March 18, AmericanHort joined a letter articulating the landscaping industry industry’s importance.

On March 24, the Federal Motor Carrier Safety Administration (FMCSA) put out guidance for drivers who have had, or will have, their licenses expire over the next few months or those who need updated medical exam. The CDC and OSHA have made available guidance for employers on how to prepare for and operate businesses while mitigating the risk of infection. That information is below.

DHS Announcement on Critical Infrastructure

The Department of Homeland Security has three times revised federal guidance on critical infrastructure sectors and essential workers. The second revision notes the explicit inclusion of “landscapers” as essential under the Public Works and Infrastructure Support sector. Note that the federal guidance is advisory only and final authority resides at the state and sometimes local level. But these changes may be helpful as AmericanHort and state partners work to support state/local decisions on who may operate consistent with health and safety guidance. Read the guidance here.

Opening Up America Again Guidelines

The Federal Emergency Management Agency (FEMA) and Centers for Disease Control and Prevention (CDC) have issued a three-phased roadmap to reopening based on the advice of public health experts. These steps will help state and local officials when reopening their economies, getting people back to work, and continuing to protect American lives.

Environmental Protection Agency (EPA)

EPA’s expertise on the safe and effective use of disinfectants against the virus that causes COVID-19 informed the development of this comprehensive plan. With the CDC, the EPA has revised Guidance for Cleaning and Disinfecting Public Spaces, Workplaces, Businesses, Schools and Homes which offers a practical, three-step process for preparing spaces for reopening.

Centers for Disease Control and Prevention (CDC)

New interim guidance is available from CDC and the Department of Labor for agriculture workers and employers.

The CDC hosts a webinar for private sector organizations and partners to update the public on the latest on the COVID-19 response.

Occupational Safety and Health Administration (OSHA)

OSHA has released updated guidance on recordkeeping requirements related to COVID-19, and how to determine of occurrence is considered a recordable illness.

Office of Foreign Labor Certification

On April 1, the DOL Office of Foreign Labor Certification issued a second round of COVID-19 related H-2A FAQ that addressed potential issues regarding the H-2A temporary agricultural labor certification program. Ongoing announcements from the DOL are being posted here.

On March 20, the Department of Labor’s Office of Foreign Labor Certification (OFLC) released a document of addressing Frequently Asked Questions relating to the COVID-19 outbreak.

Transfer of Eligible Workers

On March 19, the U.S. Department of Agriculture (USDA) and U.S. Department of Labor (DOL) announced a partnership to “facilitate the identification of foreign and domestic workers that may be available and eligible to transfer to other U.S. agricultural sector employers to fulfill critical workforce needs within the U.S. under existing regulatory authority during the COVID-19 pandemic.” U.S. Citizenship and Immigration Services recently published a temporary rule intended to make it easier for H-2A workers who are finishing a work contract in the U.S. to be transferred into a new approved agricultural job opportunity and remain working in the U.S. AmericanHort has new guidance on how the temporary changes work.

General Announcements Related to H-2 Processing

On March 26, the Department of State announced that Secretary Pompeo and the Department of Homeland Security had authorized consular officials, at their discretion, to waive the visa interview requirement for first-time and returning H-2 applicants who have no apparent ineligibility or potential ineligibility. President Trump has already signed three pieces of legislation passed by Congress to address the crisis and the economic stresses produced by nationwide efforts to slow the spread of COVID-19. Debate around additional legislation continues and we will keep monitoring these discussions

For most, the Spring season is essential to success, and businesses with limited liquidity are not well positioned to shoulder a huge financial burden at the time the industry should be heading into peak activity and cash flow generation. We had profound concerns about the burdens being placed on employers who are suffering from capacity, liquidity, and overall business problems. In the end the imperative for Congress to act outweighed the will to amend the issues with the bill that affected our members. You can read a copy of AmericanHort’s response to the Senate here.

Compliance

On March 26, the DOL made available a compliance poster (Spanish) for employers which must be displayed to fulfill notice requirements under the new law. A Field Assistance Bulletin describing WHD’s 30-day non-enforcement policy is available as well.

On March 24, the Department of Labor (DOL) provided in a Fact Sheet for Employees, a Fact Sheet for Employers and a Questions and Answers document explaining the various leave provisions included in the Families First Coronavirus Response Act that took effect on April 1, 2020. Summary

This legislation provides a sweeping stimulus to the American economy, financial support for businesses, and a backstop for state and local governments and institutions to address the Coronavirus in their community.

The legislation includes the following provisions:

  • Rebates of $1,200 for low- and middle-income individuals (gradually phased out for AGIs between $75,000 and $99,000), and an additional $500 for every child.
  • $350B in small business loans available to protect payrolls and other operating expenses, which may be forgiven in certain circumstances.
  • A 50% refundable payroll tax credit on wages paid, up to $10,000 in certain circumstances.
  • A delay on Social Security payroll tax payments for employers.

Guidelines for Communicating with Employees, Customers, and Clients

In times of uncertainty communication is more important than ever. We suggest companies consider two important paths of communication and deliver information in as calm a manner possible. The first path is for employees to help alleviate their concerns; and the second path is to connect with your customers and clients. Here are some suggestions on what your messages to these audiences might address.

Employee communication:

  • An overall statement that “we value the health and wellbeing of our employees and their families and are here to listen to your concerns”
  • Share what the company doing to protect its employees from the virus (handwashing, sanitizing, limiting meetings, limiting in-person contact, etc.)
  • Share your remote working/telecommuting options, guidelines (if available)
  • Review your processes for how the company will communicate to employees in the event of a mandatory shut down
  • Review your HR policies regarding sick time or leave. This may be a time to make some temporary modifications (i.e.: provide an advance on paid time off)

Client or customer communication:

  • Share whether the company open for business, has modified hours operation, offers delivery or order pickup services, etc.
  • Share what the company is doing to protect its customers from the virus? (handwashing, sanitizing, adding additional hand-wash stations, limiting visitors, limiting meetings, limiting in person contact, etc.)
  • Share the positive fact that plants impact our health, wellness and the environment – “gardening has not been cancelled”
  • Ask how the company can help its customers/clients in this time of uncertainty through service, payment terms, or other support

On Friday March 27, Congress passed the Coronavirus Aid, Relief, and Economic Security (CARES) Act. It’s an estimated $2 trillion package, which specifically allots $10 Billion for Economic Injury Disaster Loans (EIDLs) and $350 billion for Paycheck Protection Loans to help small businesses.
